Perry’s Restaurant Collective Action Lawsuit

On July 20, 2015, the court held a hearing on Plaintiff's (Perry's employees) motion for conditional certification of the class, which Judge Lee Yeakel granted. On August 12, 2015, Perry's stipulated that any eligible employee who timely indicates their intention to join the class action suit, will be treated as submitting consent on July 20, 2015, the date the Order was granted. The court ruled that the "lookback period" for class notice would be three years prior to the date of the conditional certification, or July 20, 2012.
